Rights of Withdrawal


Mistrerbarche.it recognizes the right of withdrawal as required by current legislation Legislative Decree 206/2005, according to which:
if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to *misterbarche.it*), he right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following point.

To exercise this right, the customer must send Mistrerbarche.it a communication to that effect, within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to: Mistrerbarche.it (operating headquarters in Via Suolo San Gennaro, 15 - 80078 Pozzuoli (NA)

or by telegram or fax always sent within the aforementioned term of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the following 48 hours.
Once we have received the aforementioned notice of withdrawal, the Mistrerbarche.it Customer Service will quickly inform the customer of the instructions on how to return the goods, which must reach Mistrerbarche.it within 10 days of authorisation.

The right of withdrawal is in any case subject to the following conditions:

  • the law applies to the product purchased in its entirety;
  • it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, attached software, etc...);
  • the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...);
  • to limit damage to the original packaging, we recommend, when possible, to place it in a second box;
  • the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided in all cases;
  • according to the law, the shipping costs relating to the return of the goods are charged to the customer;
  • the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
  • in the event of damage to the goods during transport, Mistrerbarche.it will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier of his choice and obtain the reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
  • Mistrerbarche.it is not liable in any way for damage or theft/loss of goods returned by uninsured shipments;
  • upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport.

Without prejudice to any repair costs for ascertained damage to the original packaging, Mistrerbarche.it will refund the customer the amount already paid, in the shortest possible time and in any case within 14 days of the request for withdrawal, by transferring the amount charged on the credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (Code ABI - CAB - Current account of the invoice holder).

The right of withdrawal is lost entirely, due to lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Mistrerbarche.it ascertains:

  • the lack of the external packaging and/or the original internal packaging;
  • the absence of integral elements of the product (accessories, cables, manuals, parts, etc.);
  • damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Mistrerbarche.it will return the purchased goods to the sender, charging the shipping costs to the sender. The "Satisfied or Reimbursed" guarantee present in several parts in our sales pages is to be considered applicable according to the methods indicated by the points mentioned above.


Costs
The refund must be made within 14 days of the withdrawal and must also cover the ORIGINAL delivery costs, and therefore the costs of returning the goods are excluded. The refund, as a rule, must take place with the same means of payment used by the consumer at the time of his payments. In any case, the supplier may not make the refund until the moment of receipt of the returned goods or the consumer demonstrating that he has sent them.
